CHANGESTO NEW YORK INSURANCE LAW AFFECT DIVORCING COUPLES

 Two recent changes to New York state insurance law will have a substantial impact on couples divorcing and separating. Those changes, signed into law on July 29, 2009, are:

1.    COBRA coverage will now be available in New York for 36 months.

 

2.    Families can now keep dependents on their insurance policies until age 29.

Of course, neither of these new laws apply to self-insured companies.

The practical effect of these extensions of insurance coverage will be to increase the value (or cost) of insurance coverage for divorcing couples, and therefore the impact and importance of insurance coverage as a issue to be considered and resolved in any divorce action.

If parties have been married 10 yrs, but separated for the last 2 yrs of that 10 yrs - what is the wife entitled too in the divorce if she hasn't worked fulltime during the course of the marriage? She had various part time jobs, but mostly a homemaker. There aren't any children from this marriage. There wasn't a legal separation agreement, the spouses moved into separate residences. During that 2 yrs the husband has paid all the bills associated with the marital home, utilities etc.. The home is in his name only. The checking acct is in his name only as well. The husband has provided money during that 2 yrs to the wife to maintain her standard of living. The vehicle she drives in his name as well and he has made the payments on that vehicle. Everything was in the husbands name due to bad credit of the wife, accts had been frozen before due to money owed by the wife to creditors prior to marriage. Is the wife entitled to half of his 401k, sale of the home, spousal maintenance?
